The bankruptcy code has changed drastically since a massive overhaul in 2005 and it is now more important than ever that you seek competent and passionate counsel if you think this may be the option best for you. When you are facing financial stress and overwhelming debt, I can help you stop harassing telephone calls and letters, foreclosures and collection actions. Filing for bankruptcy protection can often eliminate or greatly reduce your total debt but you should not try to navigate this complicated area of law without a competent attorney who has experience.
Bankruptcy law is a passion of mine and my goal is to help you to resolve your complicated and frightening financial matters in a way that leaves you feeling empowered, respected and relieved. The process of filing for bankruptcy protection should not leave you feeling stigmatized or humiliated. I will help you to determine whether you are a candidate for bankruptcy, which of your debts may be discharged in bankruptcy, what assets I can protect and which you may lose in a bankruptcy filing. My goal is to educate you along the way, letting you know exactly what to expect and if I anticipate you will have issues in your case so that there are no surprises for you after we file.
Chapter 7 (Personal and Business) – Chapter 7 is generally the more simple type of filing. Technically, it is the liquidation of non-exempt assets and discharge of all dischargeable debts. Most “simple” bankruptcies allow you to keep everything you own and discharge all or most of your debts. Contrary to what some people assume, you can often keep your home, your vehicle, your retirement accounts and many other assets. Each case is unique and an experienced attorney will help you to determine whether you are eligible for a Chapter 7, whether your debts are dischargeable, and whether your assets will be protected in a Chapter 7.
You can usually eliminate the following types of debt:
- Credit Cards
- Unsecured Loans
- Foreclosure or Repossession Deficiency Balances
- Medical Bills
- Many Judgments
- Certain Tax Debts
Chapter 13 – Reorganization of debts, often to save a home from foreclosure or to structure a payment plan for taxes, student loans, child support or other generally nondischargeable debts. If you have significant income, an analysis of your income and expenses may show that you must pay back all or a portion of your debt in a Chapter 13 Bankruptcy. Chapter 13 plans last between 3-5 years
Debt Restructuring and Negotiation – If you cannot or do not want to file for bankruptcy protection, I may be able to negotiate your debts with your creditors.
Business Insolvency/Liquidation Planning – If you have a business and need help shutting it down and liquidating inventory and negotiating with your creditors, I can discuss your options with you. Sometimes this may lead to a bankruptcy filing but sometimes not. I can help you determine your course moving forward.
